Types of Workplace Discrimination

Although employment discrimination can occur in many forms, some of the most common cases we see are:

  • Disability - Many employers fail to meet the needs of their disabled employees whether it is a mental or physical condition. This can impede employees from meeting the requirements of their jobs.

  • Gender - When individuals are victim to gender discrimination, it may be in the form of not being hired or promoted or being harassed, or wrongfully terminated.

  • Sexual harassment - When sexual harassment occurs in the workplace and is initiated by  third parties, employers are obligated to address the issue.

  • Race/national origin - This type of employment discrimination can occur in the form of unfair treatment or harassment by disparaging jokes or comments related to race or national origin.

  • Religion - Workplaces are required to accommodate to the religious beliefs and practices of their employees. For example, employees sometimes have the right to pray at work, take time off for religious holidays and dress in garments common to their religious practices.

  • Sexual orientation - Employment discrimination of gay, lesbian, bisexual and transgender employees also can occur in many ways, including harassment.

  • Marital status - We have handled cases in which married couples were wrongly denied the right to work together based on their relationship.

  • Age Discrimination - Employers are prohibited from discriminating against people based on their age.
